A Nation-Leading Anti-Sexual Harassment Agenda Updated Policy

New York State was one of the first states in the nation to pass groundbreaking and comprehensive legislation in 2018 aimed at preventing sexual harassment and gender discrimination at work. Included in that legislation was the requirement to review and update the state's model policy and training every four years.

In 2022, a new nation-leading sexual harassment prevention policy was crafted by the New York State Department of Labor, in consultation with the New York State Division of Human Rights, through an in-person hearing as well as online feedback from workers, employers, and other stakeholders across New York State.

The updates include a new sexual harassment prevention policy and sexual harassment prevention training with guidelines for employers and employees as well as an interactive video and answer sheet to assist training.

People experiencing sexual harassment in the workplace may use the free and confidential hotline to connect with pro-bono attorneys on sexual harassment issues, or submit a complaint. Resources and support services are also available for victims of sexual harassment and discrimination.

Protections from Harassment
The Human Rights Law now protects victims of harassment, including sexual harassment, in important new ways such as ensuring that harassment does not need to be severe or pervasive to be against the law.
Model Sexual Harassment Policy and Training For All Employers
Beginning in October 2018, Employers must adopt a sexual harassment prevention policy and training or use a similar policy and training that meet or exceeds the law’s minimum standards.
Statute of Limitations Extended
Effective August 12, 2020, the statute of limitations for filing a sexual harassment complaint with the Division of Human Rights is extended from one year to three years.
